Welcome to XAATEX.

These Terms of Use set out the rules, rights and responsibilities for using the XAATEX platform, including its website, services, features and other resources made available to users.

By creating an account, purchasing a license or using any feature of XAATEX, you declare that you have read, understood and fully agree to these Terms of Use.

If you do not agree with any provision of this document, you must not use the platform.

XAATEX is a web platform developed for the visualization, organization and monitoring of data coming from compatible devices that use communication formats supported by the platform, such as JSON transmitted over USB, Bluetooth Low Energy (BLE), WebSocket and other compatible protocols.

The purpose of XAATEX is to offer a modern, flexible and highly configurable tool for building telemetry dashboards, monitoring sensors, prototyping embedded systems and developing technical applications.

These Terms constitute a legal agreement between the user and the owner of XAATEX, governing access to and use of the platform.

We recommend that you read this entire document before using the service.

For the purposes of these Terms of Use, the terms below have the following meanings:

XAATEX

Web platform developed for building telemetry dashboards, real-time data visualization, monitoring of sensors and compatible devices, as well as other features made available by the service.

Platform

The set formed by the website, web application, resources, services, features, interfaces, documentation and other components that make up XAATEX.

User

Individual or legal entity who creates an account, purchases a license or uses any feature made available by the platform.

Account

Individual registration created by the user in order to access XAATEX resources.

License

Right to use XAATEX granted to the user under the conditions established in these Terms of Use.

Dashboard

Workspace created by the user to organize widgets, view information and monitor data coming from compatible devices.

Widget

Visual component of XAATEX used to represent information, charts, indicators, radars, gauges, consoles, tables or any other element available on the platform.

Compatible Device

Equipment, microcontroller, sensor, computer or system capable of sending data in formats accepted by XAATEX.

Telemetry Data

Information transmitted by devices connected to the platform, including, among others, sensor readings, states, measurements, events and other technical data.

JSON

Structured data format supported by XAATEX for communication between devices and dashboards, as well as any other formats that may be added in future versions.

Services

All features offered by XAATEX, including dashboard creation, device management, widgets, settings, visualization resources, authentication and other services made available by the platform.

Lifetime License

License granted through a single payment, allowing the user to use the acquired version of XAATEX for an indefinite period, subject to the conditions set out in these Terms of Use.

Updates

Fixes, improvements, optimizations and new features made available for the licensed version of XAATEX, according to the update policy in force.

Paddle

Platform responsible for payment processing, receipt issuance, billing and other financial operations related to the purchase of XAATEX licenses.

Supabase

Platform used for user authentication, account management and other infrastructure services necessary for the operation of XAATEX.

Whenever these terms are used in this document, they shall be interpreted in accordance with the definitions established in this section.

By creating an account, purchasing a license, accessing or using any feature made available by XAATEX, the User declares that they have read, understood and fully agree to these Terms of Use, as well as to the Privacy Policy and any other documents applicable to the platform.

Use of XAATEX is conditional upon full acceptance of these Terms. If the User does not agree with any provision established herein, they must immediately stop using the platform and must not register or purchase a license.

The User declares that they have the legal capacity to enter into this agreement. If they use XAATEX on behalf of a company, institution or other legal entity, they declare that they have the authority to accept these Terms on behalf of that organization.

Acceptance of these Terms produces legal effects from the first access to the platform, the creation of the account or the purchase of a license, whichever occurs first.

XAATEX may update these Terms of Use from time to time to reflect improvements to the platform, legal changes or operational changes. Whenever there are relevant modifications, the updated version will be made available to Users through the official website or the platform itself.

Continued use of XAATEX after a new version of these Terms comes into force will be considered agreement with the changes made, without prejudice to the rights provided for in applicable law.

In order to use certain features of XAATEX, the User must create a valid account, providing the information requested during the registration process.

The User declares that all information provided is true, complete and up-to-date, and undertakes to keep it accurate throughout the entire period of use of the platform.

Each account is for individual use and may not be shared with third parties in a way that compromises the security of the platform or violates these Terms of Use.

The User is fully responsible for the confidentiality of their access credentials, including e-mail address, password and any other means of authentication used to access their account.

XAATEX is not responsible for losses, damages or unauthorized access resulting from improper use, disclosure or negligence in protecting the access credentials by the User.

If the User identifies any unauthorized use of their account or suspects that their credentials have been compromised, they must change their password immediately and, when necessary, contact XAATEX official support.

XAATEX may request verification of the e-mail address provided during registration as a security measure and to protect the User's account.

The User is responsible for all activities carried out through their account, except when demonstrably caused by a failure attributable to XAATEX itself.

XAATEX may temporarily suspend or restrict access to the account when there are reasonable indications of fraud, misuse, attempted unauthorized access, violation of these Terms of Use or situations that may compromise the security of the platform or of other Users.

The User may request the closure of their account at any time through XAATEX official support channels. The request will be analyzed and processed within a reasonable time, and confirmation of the requester's identity may be required to protect the account itself.

The closure of the account does not, by itself, cancel obligations previously assumed by the User nor affect rights already acquired by the parties.

The license acquired by the User will remain linked to the account used during the purchase, subject to the conditions established in the "License of Use" section of these Terms.

By purchasing a XAATEX license, the User receives a limited, non-exclusive, non-transferable license of use, revocable only in the cases provided for in these Terms of Use or in applicable law.

Unless otherwise stated, the license is granted through a single payment and remains valid for an indefinite period for the acquired version of the platform, in accordance with the conditions established in these Terms of Use. This modality is commercially presented as a Lifetime License and is not subject to recurring charges, subscriptions or monthly fees.

The license authorizes the User to use XAATEX for personal, academic and commercial purposes, provided that such use complies with these Terms of Use and with applicable law.

The license is linked to the User's account used during the purchase and may be used on different devices belonging to the same User, provided that access is carried out exclusively by them and does not result in improper sharing of the account or license.

It is prohibited to:

• resell, sublicense, rent, assign or commercialize the license without express authorization from the owner of XAATEX;
• share access credentials with third parties for simultaneous or continuous use of the platform;
• copy, reproduce, distribute, modify, decompile, reverse engineer or attempt to obtain the source code of XAATEX, except when expressly permitted by applicable law;
• use the platform for illicit or fraudulent activities or activities that violate third-party rights.

The purchase of a license does not transfer to the User any intellectual property right over XAATEX, including its source code, visual identity, documentation, trademarks, logos, interface, resources, technologies or any other assets related to the software.

The Lifetime License grants the User the right to use, for an indefinite period, the version of XAATEX acquired during the purchase, while it remains made available by the platform owner, subject to the conditions of these Terms of Use.

The owner of XAATEX may make available updates, improvements, fixes and new features for the licensed version in accordance with its development policy, and is not obligated to maintain any specific update schedule.

If new major versions of XAATEX are released in the future, representing a significant evolution of the product, substantial architectural changes, new commercial models or features that characterize a new product, such versions may be sold separately and will not be automatically included in the originally acquired license.

Nothing in these Terms obliges the owner of XAATEX to develop specific features, to maintain support for a determined period or to make future major versions of the platform available free of charge.

The use of certain XAATEX features may depend on the purchase of a valid license, according to the commercial model in force at the time of purchase.

Payments related to the purchase of licenses are processed by third-party payment providers, currently using the Paddle platform, which is responsible for financial processing, receipt issuance, collection of applicable taxes and other procedures related to the transaction.

XAATEX does not store complete credit card information, banking data or other payment means used by the User; such information is processed directly by the responsible payment provider.

The license will be granted after confirmation of payment by the respective provider, and a period may be required for transaction validation, fraud prevention or financial processing.

In exceptional situations, such as suspected fraud, chargeback, payment cancellation, improper use of the payment means or legal determination, the granting or maintenance of the license may be suspended until the situation is duly clarified.

Receipts, invoices and tax documents related to the purchase may be issued by the payment provider, in accordance with applicable law and the policies adopted by that provider.

The User is responsible for providing correct information during the purchase process, including a valid e-mail address, since it may be used for communication related to the acquired license.

Any requests for cancellation, refund or payment dispute will be analyzed in accordance with the XAATEX Refund Policy and, when applicable, will also be subject to the policies and procedures of the payment provider used.

The owner of XAATEX reserves the right to change the payment provider used by the platform at any time, provided that such change does not reduce the rights already acquired by Users in relation to the licenses regularly obtained.

After confirmation of payment, the license will be linked to the account used by the User during the purchase, permanently integrating that account, subject to the conditions set out in these Terms of Use.

Subject to the provisions of these Terms of Use and applicable law, the User may use XAATEX for the purposes for which the platform is intended, including but not limited to:

• creating, configuring and customizing telemetry dashboards;
• connecting compatible devices using the communication means supported by the platform;
• viewing, monitoring, organizing and analyzing data from sensors, microcontrollers, embedded systems and other compatible devices;
• using the widgets, tools and other resources made available by XAATEX to build monitoring and data visualization interfaces;
• developing, testing, validating and prototyping projects in hardware, software, automation, robotics, Internet of Things (IoT), research, teaching and technical applications in general;
• using XAATEX in personal, academic, professional and commercial projects, subject to the limits established in these Terms of Use;
• storing, organizing and managing dashboards, settings and other resources made available by the platform;
• using future features made available by XAATEX, provided they are compatible with the acquired license and subject to the conditions of these Terms.

The User may use XAATEX in commercial activities, including product development, research, provision of services, technical demonstrations, prototyping, laboratory testing, automation and other professional applications, provided that the use of the platform does not violate these Terms of Use or applicable law.

Use of XAATEX does not transfer to the User any intellectual property rights over the platform, being limited to the right of use granted by the acquired license.

The User is responsible for the proper use of the platform, as well as for the data transmitted, connected devices and projects developed with the assistance of XAATEX.

It is expressly prohibited to use XAATEX for any illicit or fraudulent purpose or for any purpose incompatible with these Terms of Use.

Without prejudice to other restrictions set out in this document or in applicable law, the User may not:

• use the platform to carry out illegal activities or activities that violate third-party rights;
• share, sell, lend, sublicense, rent or assign their account or license to third parties without express authorization from the owner of XAATEX;
• attempt to gain unauthorized access to the platform, servers, databases, internal systems or accounts of other users;
• reverse engineer, decompile, disassemble, modify, copy or attempt to obtain the source code of the platform, except when expressly permitted by applicable law;
• remove, hide or alter copyright notices, trademarks or any intellectual property identifiers present in XAATEX;
• use bots, automated scripts or any mechanism intended to compromise the operation, stability or security of the platform;
• interfere with the normal operation of XAATEX, carry out unauthorized penetration testing or improperly exploit vulnerabilities;
• transmit files, code, programs or any malicious content that may compromise the security of the platform or of other users;
• use the platform to distribute spam, offensive, discriminatory or fraudulent content or content that violates third-party intellectual property rights;
• use XAATEX in a way that may cause damage, overload, unavailability or degradation of the services offered;
• use the platform in violation of these Terms of Use or applicable law.

Failure to comply with the provisions of this section may result in the temporary or definitive suspension of the account, revocation of the license when applicable, adoption of appropriate legal measures and other actions necessary to protect the platform, its users and its rights.

XAATEX may receive updates intended to improve its stability, performance, security, compatibility and user experience.

These updates may include, among others, bug fixes, performance optimizations, interface improvements, new features, compatibility adjustments with supported devices and general improvements to the platform.

The owner of XAATEX may make updates available for the licensed version whenever it considers appropriate, and is not obligated to maintain a specific development schedule or to make new features available within any determined time frame.

Updates made available for the acquired version may be provided at no additional cost, in accordance with the development policy in force.

Future versions that represent a new major version of XAATEX, introduce significant changes to the product or adopt a new commercial model may be made available as independent products, subject to their own commercial conditions.

The owner of XAATEX reserves the right to improve, modify, replace or discontinue platform features whenever necessary to keep up with technological developments, legal requirements, operational improvements, security matters or decisions related to the development of the product.

Whenever possible, relevant changes will be communicated to Users through XAATEX official channels.

No provision of this section shall be interpreted as an obligation to develop specific features, maintain experimental resources, make future major versions of XAATEX available free of charge or guarantee permanent compatibility with any hardware, browser, operating system, service or third-party technology.

The owner of XAATEX undertakes to adopt reasonable measures to keep the platform available, secure and fully operational, seeking to offer a reliable experience to its Users.

However, since this is a web platform that depends on its own infrastructure and on services provided by third parties, XAATEX may be temporarily unavailable due to scheduled maintenance, updates, technical failures, infrastructure problems, interruptions of external services, force majeure events or other circumstances beyond the control of the platform owner.

Whenever possible, scheduled maintenance that may significantly impact service availability will be announced in advance through XAATEX official channels.

The owner of XAATEX may perform technical interventions, security updates, infrastructure improvements and other procedures necessary to preserve the stability, integrity, security and proper operation of the platform, even if this results in temporary service interruptions.

Although measures are taken to minimize interruptions, XAATEX does not guarantee continuous, uninterrupted or fault-free availability, but undertakes to act diligently to restore the operation of the platform whenever possible.

The owner of XAATEX cannot be held responsible for unavailability resulting from failures or interruptions caused by third-party services, including but not limited to hosting providers, cloud infrastructure, authentication services, payment providers, communication networks, browsers, operating systems, User equipment or any other external technologies necessary for the operation of the platform.

The User acknowledges that any temporary interruptions resulting from maintenance, updates, security, legal adjustments or external factors do not constitute a breach of these Terms of Use, provided that the owner of XAATEX takes reasonable measures to restore normal service.

XAATEX is a platform intended for the visualization, organization and monitoring of data coming from compatible devices, and does not constitute a security system, a critical control system, a certified measuring instrument or equipment intended for automatic decision-making.

The User is solely responsible for the configuration of the platform, the connected devices, the transmitted data and the interpretation of the information presented by the dashboards and widgets.

Although the owner of XAATEX adopts reasonable measures to keep the platform stable, secure and functional, it does not guarantee that the services will be free from errors, interruptions, incompatibilities or failures resulting from external factors or third-party technologies.

The owner of XAATEX shall not be liable for direct or indirect damages arising from:

• improper use of the platform;
• incorrect configuration of dashboards, widgets or devices;
• failures of hardware, firmware, sensors, microcontrollers or connected equipment;
• errors, inconsistencies or loss of data sent by external devices;
• unavailability of third-party services necessary for the operation of the platform;
• incompatibilities between XAATEX and browsers, operating systems, equipment or third-party technologies;
• technical, operational, commercial or other decisions of any nature taken by the User based on the information presented by XAATEX.

The User acknowledges being responsible for validating data received from their devices before using it in critical applications, industrial processes, research, automation systems, commercial projects or any other activities that depend on a high degree of reliability.

XAATEX does not replace independent mechanisms of validation, monitoring, redundancy, protection or security that may be necessary for the correct operation of equipment, processes or systems developed by the User.

No provision of these Terms limits or excludes liabilities that cannot be waived under applicable law.

The User acknowledges that XAATEX is a support tool for development, monitoring and data visualization, and it is solely up to the User to verify the platform's suitability for the specific needs of each project and to ensure that its use complies with the applicable technical, legal and security requirements.

XAATEX, including but not limited to its source code, architecture, interface, visual identity, logos, trademarks, documentation, texts, images, illustrations, icons, dashboards, widgets, graphic elements, audiovisual resources, supporting materials and other components of the platform, is protected by applicable legislation on intellectual property, copyright, trademarks and other relevant rules.

All rights, titles and interests related to XAATEX belong exclusively to its owner or to the respective licensors, when applicable.

The purchase of a license of use does not transfer to the User any intellectual property rights over XAATEX, granting only the right to use the platform under the conditions established in these Terms of Use.

The User is forbidden to reproduce, copy, modify, distribute, commercialize, sublicense, publicly make available, reverse engineer or economically exploit any part of XAATEX without the prior and express authorization of the owner, except in the cases provided for in applicable law.

The User retains all rights over the data, dashboards, configurations, projects and other contents created by them using the platform, and such contents are not transferred to the owner of XAATEX as a result of the use of the service.

By using XAATEX, the User does not acquire any rights over the trademarks, logos, trade names, visual identity or other distinctive signs related to the platform, except with express written authorization.

Any unauthorized use of the protected elements of XAATEX may subject the responsible party to the applicable administrative, civil and criminal measures, in accordance with applicable law.

Nothing in these Terms of Use prevents the User from developing their own projects, devices, dashboards, integrations or solutions using XAATEX as a support tool, with such creations remaining their exclusive property, provided that they do not incorporate or reproduce protected elements of the platform beyond what is permitted by the license granted.

XAATEX values the privacy of its Users and undertakes to treat personal data in a responsible and transparent manner and in compliance with applicable legislation on data protection.

During the use of the platform, information necessary for the operation of the service may be collected and processed, including, among others, registration, authentication, licensing, communication with the User and technical information related to the use of the platform.

The processing of such data has the purpose of enabling access to XAATEX services, ensuring the security of the platform, managing licenses, providing support, complying with legal obligations and continuously improving the User experience.

XAATEX adopts reasonable technical and organizational measures to protect the data under its responsibility against unauthorized access, loss, alteration, disclosure or any form of improper processing.

Certain XAATEX features depend on services provided by third parties, including authentication, hosting, infrastructure and payment processing platforms. In such cases, the processing of certain data may occur through these providers, subject to their respective privacy policies and applicable legal rules.

Information related to payment processing is handled directly by the responsible payment provider and is not stored in full by XAATEX.

The specific conditions on the collection, use, storage, sharing, retention and other aspects related to the processing of personal data are described in the XAATEX Privacy Policy, which is an integral part of these Terms of Use and must be consulted by the User.

By using XAATEX, the User declares to be aware that their data may be processed in accordance with the purposes described in these Terms of Use and in the platform's Privacy Policy.

The dashboards, configurations, projects and other contents created by the User remain under their ownership. XAATEX does not claim any property right over such contents, using them only to the extent necessary to provide the features of the platform, as described in the Privacy Policy.

The User may request the closure of their account at any time, subject to the conditions set out in these Terms of Use and in applicable law.

The closure of the account will result in the loss of access to features that require authentication, as well as to resources linked exclusively to the User's account.

Whenever permitted by applicable law, certain records may be kept for the period necessary to comply with legal, regulatory or tax obligations, to prevent fraud, to resolve disputes or to protect the rights of the owner of XAATEX.

The owner of XAATEX may temporarily suspend or definitively terminate an account when there are reasonable indications of:

• violation of these Terms of Use;
• fraudulent use of the platform;
• improper sharing of accounts or licenses;
• attempts to compromise the security, stability or operation of the platform;
• use of the platform for illicit activities;
• judicial determination or legal obligation.

Whenever possible and compatible with the nature of the incident, the User will be informed in advance about the suspension or termination of the account, and may be given the opportunity to remedy the situation.

The termination or suspension of the account does not affect rights and obligations already established between the parties, including legal obligations, responsibilities arising from the use of the platform and other provisions set out in these Terms of Use.

After the closure of the account, the processing of remaining personal data will follow the provisions of the XAATEX Privacy Policy and applicable law.

The User acknowledges that the definitive deletion of their account may result in the permanent loss of the license linked to that account, as well as of access to the associated resources, except when account recovery is possible through the means officially made available by XAATEX.

The owner of XAATEX may review and update these Terms of Use whenever necessary to reflect changes in applicable legislation, evolution of the platform, the inclusion or discontinuation of features, operational changes, service improvements or any other circumstances that justify their update.

The most recent version of these Terms of Use will always be available through XAATEX official channels, containing its respective effective date.

Whenever reasonably possible, XAATEX will seek to communicate to Users any changes considered relevant through the platform itself, the official website or other communication channels used by the platform.

Changes to these Terms of Use will take effect as of their effective date and will not affect rights regularly acquired by Users, except when required by applicable law or by a decision of a competent authority.

Continued use of XAATEX after a new version of these Terms comes into force will be considered as an expression of awareness and agreement with the changes made.

If the User does not agree with any changes to these Terms of Use, they may stop using the platform and request the closure of their account, subject to the conditions set out in this document.

It is the User's responsibility to periodically consult the current version of these Terms of Use in order to remain informed about any updates.

These Terms of Use shall be interpreted and governed in accordance with the laws of the Federative Republic of Brazil.

In the event of any controversy related to the interpretation, validity, execution or fulfillment of these Terms of Use, the parties undertake, whenever possible, to seek an amicable solution through dialogue and negotiation.

If a consensual solution is not possible, any conflicts will be submitted to the competent court, as established by applicable Brazilian legislation.

If any provision of these Terms of Use is considered invalid, illegal or unenforceable by a competent authority, the remaining provisions will remain fully valid and effective, to the maximum extent permitted by applicable law.

Any tolerance by the owner of XAATEX regarding the non-compliance with any provision of these Terms of Use shall not constitute a waiver of rights, novation or contractual modification, and all other provisions of this document shall remain fully enforceable.
